Sean C. Campbell is an experienced litigator representing businesses, professionals, and government entities in complex disputes, regulatory matters, and professional licensing and ethics proceedings. Sean represents clients through a wide range of business litigation, including contract disputes, business torts, and employment-related matters. His litigation experience includes:

Sean has extensive experience representing businesses and individuals in government-related litigation, regulatory enforcement actions, and administrative appeals. His background as Assistant Counsel and Lead Litigation Attorney for the Pennsylvania Department of Community and Economic Development gives him unique insight into government operations and regulatory processes. In that role, he handled matters involving state funding, economic development programs, Act 47 municipal recovery, Right-to-Know Law disputes, and tax credit administrative appeals. With an understanding of state and local governments, Sean advocates for clients navigating regulatory challenges, compliance matters, and disputes with government entities. 

Professional Licensing and Ethics Defense
Sean regularly advises and defends licensed professionals in Pennsylvania facing disciplinary proceedings, licensure disputes, and ethics investigations. He has represented clients before licensing boards and administrative tribunals in cases involving suspension, revocation, and professional misconduct allegations. Additionally, he counsels legal professionals on ethics compliance and disciplinary defense before The Disciplinary Board of the Supreme Court of Pennsylvania. 

Prior Experience
Sean served as Assistant Counsel for the Pennsylvania Governor’s Office of General Counsel (OGC), Pennsylvania Department of Community and Economic Development (DCED), where he was the lead litigation attorney for the agency. He represented the Commonwealth in complex administrative appeals, financial recovery proceedings, and regulatory enforcement actions. His litigation experience includes high-profile cases involving the Pennsylvania Supreme Court, Commonwealth Court, and federal courts. 

Before joining McNees, Sean focused on commercial and construction litigation, representing owners, contractors, and subcontractors in contract disputes, business torts, insurance coverage issues, and employment law matters. He also handled business disputes, officer and shareholder liability issues, professional licensing defense, and regulatory matters. 

Sean began his legal career as a law clerk to the Honorable Sylvia H. Rambo of the U.S. District Court for the Middle District of Pennsylvania and the Honorable J. Wesley Oler Jr. of the Cumberland County Court of Common Pleas.

EXPERIENCE/REPRESENTATIVE CASES

  • Successfully obtained a dual grant of summary judgment and preliminary objections challenging mechanic’s lien in Philadelphia County Court of Common Pleas 
  • Successfully prosecuted construction defects case to jury trial in Cumberland County Court of Common Pleas and further obtained prejudgment interest and attorney’s fees awards in post-trial motions practice 
  • Represented the General Assembly in Wolf v. General Assembly, wherein the Governor and Secretary of the Commonwealth brought suit in both the Supreme and Commonwealth Courts contesting the constitutionality of proposed constitutional amendments after their first passage through the legislature 
  • Represented the House Republican Caucus in litigation before the Commonwealth Court involving Governor Wolf’s attempt to join the Regional Greenhouse Gas Initiative through administrative regulation 
  • Served as in-house counsel for the Coordinator in Davin v. City of Harrisburg, 569 MD 2011, wherein the Commonwealth Court oversees the City of Harrisburg’s compliance with the financial recovery plan under the Act 47 Program 
  • Successfully defended the Commonwealth Financing Authority and the Department in U.S. Venture v. Commonwealth of Pennsylvania, Department of Community and Economic Development, et al., 2021 Pa. LEXIS 3138, in which the Pennsylvania Supreme Court affirmed the Commonwealth Financing Authority’s denial of a $1.2 million grant award 
  • Successfully defended an appeal of a Keystone Opportunity Zone tax credit denial in Venture Navy Yard, LLC v. Dep’t of Cmty. & Econ. Dev., 189 A.3d 1137 (Pa. Commw. Ct. 2018), in which the plaintiff sold their business before the recapture term had expired under the statute 
  • Defended licensed professionals before the Pennsylvania Bureau of Professional & Occupational Affairs
  • Counseled legal professionals on ethical issues in disciplinary enforcement actions brought by the Disciplinary Board of the Supreme Court of Pennsylvania
