McNees Attorneys Successfully Defend $6.2 Million Claim

HARRISBURG, Pa. – (October 15, 2018) The Litigation Practice Group at McNees Wallace & Nurick LLC successfully defended a $6.2 million claim against Union County, Pennsylvania medical facility, Evangelical Community Hospital, four individual physicians, and the Hospital’s former CEO. The case was brought by a physician who was suspended in 2012 and then reinstated with a proctoring requirement. It was tried over a three-week period in September 2018. After the close of testimony in the first phase of the trial, the Court granted the Defendants’ motion for directed verdict on behalf of one defendant on one claim. The jury returned a mixed verdict, which was overturned when Judge Michael Sholley granted the Defendants’ Motion for Judgment notwithstanding the verdict. As a result of the verdict and the Judge’s orders, all defendants have immunity from damages pursuant to the federal Healthcare Quality Improvement Act. The case was tried by Carol Steinour Young, Esq. and Dana Chilson, Esq. of McNees Wallace & Nurick LLC.
