The Occupational Safety and Health Administration (OSHA) is expected to issue its hotly anticipated COVID-19 Emergency Temporary Standard (ETS) any day. The Biden Administration has estimated that the ETS will “impact over 80 million workers in private sector businesses” and will require employers with more than 100 employees to require vaccination or weekly COVID-19 testing for all employees. Join Andrew Levy, Adam Long, and Abbegael Giunta from the Labor and Employment Group to review the requirements of the ETS, reasonable accommodation exceptions, potential repercussions for employers who are not in compliance, and the predicted legal challenges to OSHA’s authority to issue the ETS.
