HARRISBURG, Pa. – (January 16, 2020) McNees Wallace & Nurick LLC attorneys Ken Stark, Matthew Garber and Errin McCaulley presented at the Issues in Pennsylvania Energy & Electric Utility Regulation Halfmoon Seminar in Harrisburg, Pa. on Wednesday, January 15, 2020.
Ken Stark and Matthew Garber delivered the session “PA PUC and FERC Jurisdiction Over Electric Public Utility Service: Overview and Current Issues.” The duo discussed how the U.S. Constitutional framework of split federal/state jurisdiction has significant impacts on current energy issues, including the recent FERC order on PJM’s capacity market. The session also covered current issues in transmission planning, Pennsylvania renewable/alternative energy and issues outside of PUC/FERC jurisdiction.
Errin McCaulley presented “National Pollutant Discharge Elimination System (NPDES) Construction Storm Water Permitting and On-line Permitting Process,” covering construction stormwater permit requirements; construction stormwater compliance and enforcement; and the requesting of authorization on-line. Errin also discussed recent changes to construction stormwater permitting in Pennsylvania and the implications for developers.
Ken’s practice focuses on the representation of consumer-oriented interests in state and federal regulatory proceedings; and appellate court proceedings involving electricity, natural gas and oil pipeline issues.
Matthew represents business and municipal clients in utility-related contract negotiations and energy litigation. He focuses on achieving cost savings for clients on their electric, natural gas and water/wastewater utility services.
Errin regularly advises clients on compliance with federal and state regulatory programs, including the Emergency Planning and Community Right-to-Know Act and other programs administered by the Pennsylvania Department of Environmental Protection; the federal Environmental Protection Agency; and the Occupational Safety and Health Administration.
