The attorney client privilege safeguards communications between clients and their attorneys from later disclosure to third parties. This privilege often becomes critical when a client subsequently engages in litigation with an opponent who seeks to obtain the contents of those communications.
The privilege, however, is not absolute, and it is important to understand the instances in which the privilege does not apply.
In this video, McNees litigation attorney Rachel Hadrick discusses a recent decision where the attorney client privilege did not apply to communications made between attorney and client sent via an email account owned by the client’s employer.
